Tycoon Sues State Over  Breach of  Lease

A businessman has taken the Nairobi Regional Commissioner, Nairobi County Commissioner and the Starehe Division Officer Commanding Police Division (OCPD) to court for stopping him from constructing a restaurant inside a government compound.

The complainant Hussein Sheikh Dahir of Huska Construction Company is constructing a restaurant on Piazza Area on L.R No. 209/16954 at Teleposta Towers which houses Posta and other government ministries and departments. The compound belongs to Kenya Postal Services.

The three respondents had stopped the construction citing security reasons which prompted the complainant to seek a court order that restrained the Regional Commissioner, County Commissioner and Starehe Division OCPD from interfering with the construction works.

When the officers received the court order from Milimani Commercial Court, they too sought a court order which stopped the construction from going on, but the complainant went back to court saying that his material was being wasted on the ground.

Senior Resident Magistrate Peter Muholi who presided over the interpartes hearing on 24 July 2019, visited the site Tuesday in the company of the complainant, the respondents and their lawyers to ascertain if the materials are going to waste.

He told the parties that he will give his ruling on Friday August 23rd this year.
