Eight people arrested by detectives Monday for allegedly planning to disrupt Mashujaa day celebrations at Gusii stadium in Kisii County have been released on a free bond and without conditions.
The suspects included a former Kisii town mayor, Samuel Kenani and Bobaracho MCA Ibrahim Ongubo, Stephen Onsare, James Makanda, Isaac Obare, Samuel Momanyi, Barnabas Mwoki and Paul Orenge.
Releasing the suspects Kisii chief magistrate Nathan Shihundu ruled that the detectives had had sufficient time to complete investigations within three days they held them in custody.
The magistrate further ruled the suspects could not be detained further by the detectives on the basis of interfering with potential witnesses who were yet to record statements on incitement charges they were likely to face.
The magistrate added that the suspects could still be arraigned in court when the investigations were concluded and charges drawn.
Philemon Ochwang’i, one of the suspects’ lawyers, had urged the court to release them owing to the absence of charges.
He had also applied for release of their cell phones confiscated by the detectives during the arrest.
The case will be mentioned Friday October 23.
