A man has been convicted by the Loitoktok law court for defiling a 13-year-old girl.
Moses Mutunga Mutuku, who was convicted by Resident Magistrate Nelson Njuguna is said to have committed the offence on November 2, 2023 at Isinet trading centre in Loitoktok Sub County.
While testifying before the court during the trial, Mary Mukandi, the mother to the minor had narrated how on the material day at around 8.00 am had left home for her business leaving her daughter to wash clothes.
However, at around 4.00pm when she called her neighbor to reach out to her daughter, she was informed had not been seen since 9.00am, which prompted her to go back home.
She was informed her daughter went to their neighbour’s house for laundry, however when she went there she was told her daughter went back home.
She returned home and alerted a lady working as a Nyumba Kumi elder to assist in the search of her daughter.
While waiting for the lady her daughter emerged from a different direction other than their neighbor’s place, giving explanation that her mother doubted, hence escorted her to police station.
When interrogated she said after washing clothes she went to the house of the accused where they had sex.
The girl was escorted to Loitoktok Sub County hospital for medical examination, where it was established she was defiled before the accused was later arrested.
In court the accused denied the allegations citing he was framed for an offence he never committed.
However, the court found the prosecution had proved the case beyond reasonable doubt, hence the conviction.
The case was set for sentencing on February 21.
