Kabarnet court fines three women Sh28,000 for possessing chang’aa

A Kabarnet court has handed three people a fine of Sh 28,000 in total after being found in possession of 37 litres of changaa (a traditional brew).

 Esther Chesang, Fenadis Langale and Dennis Toroitich appeared before Senior Resident Magistrate (SRM) Edwin Mulochi and charged with being in possession of alcoholic drinks contrary to section 27(1)(b) as read with section 27(4) of the alcoholic drinks control act no.4 of 2010.

 The particulars of the case stated that on February 15th 2025 at 5:30 pm at Sokonin village, Koriema Sub location, Kimalel location in Baringo South Sub County within Baringo County, the three were found in possession of alcoholic drinks namely “Chang’aa “which did not conform to the requirements of alcoholic drinks control act no. 4 of 2010.

Langale and Toroitich pleaded guilty of the charges while Chesang pleaded not guilty of the charges read to them before the court.

In mitigation, Langale and Toroitich prayed for the court for leniency.

Edwin Mwaita, an advocate in the matter, prayed the court for Chesang to be released on free bond.

He told the court that she is 58 years old, a single mother of four and an ECDE teacher.

Mwaita in his submission said that the chief, assistant chief and elders who made the arrest assaulted her thus leading to the swelling of her hand.

The magistrate in his ruling ordered Langale and Toroitich to pay a fine of sh.10,000 each in default to serve one month each in prison.

Mulochi after considering the plea from Mwaita, ordered her to be released on a cash bail of Sh 8,000.

Chesang’s case will be mentioned on March 7 and a hearing date has been slated for March 19 this year.
