Five suspects in fraud case have alternative of out of court settlement

A Loitoktok law court has instructed parties involved in a fraud case worth Sh1.83 million to seek an out-of-court settlement.

This is after the defence counsels in the case indicated to the court the desire of the parties, to settle the matter out of court, which was welcomed by the prosecution.

Emmaculate Njeri, Fridah Gatwiri, Titus Kiplimo, Abigael Wachuka, Sophia Wachuka and James Kariuki, who appeared before Resident Magistrate, Nelson Njuguna, are jointly charged for conspiring to defraud Salome Njeri Munene Sh 1, 833, 100 in false pretense were in capacity to sell her 600 bags of maize.

The five are also facing another count of stealing the said amount of money, which happened on September 13, 2023 at Ilasit area of Kaiado County.

Njeri and Wachuka are also facing alternative charges of dishonestly handling stolen property where Njeri is said to have received Ksh 300, 000 in her Mpesa mobile account, while Wachuka received Sh 1, 333, 100 in her Equity Bank account.

Njeri is facing another count of falsely representing herself as Fridah Gatwiri for defraud, with Kiplimo arrested after being positively identified by an employee of the complainant. Njeri, Wachuka and Kiplimo were arrested on September 14 last year, while Sophia and Kariuki were arrested one month later.

As per this moment, the court directed the matter to be mentioned on February 6 2024 for confirmation of the settlement.
