Defiler Blames the Devil for Crime

A 63 year old watchman shocked a Kiambu court Friday, when he pleaded guilty to a charge of defiling a 12 year old girl at Githurai 44 in Kiambu County.

Wilson Kimani  Macharia told Kiambu Senior Principal Magistrate Stella Atambo, “Yes I did it, but I was tempted by the devil into committing the act.”

He had been charged that on January 14th at Githurai, he unlawfully had carnal knowledge of the 12 year old girl contrary to section contrary to the sexual offences Act.

For the prosecution, the state counsel Christine Mbevi told the court that she was yet to be furnished with the birth certificate of the complainant which she expected from the investigating officer.

She added that she already had in her custody all the other exhibits including the doctor’s report and the P3 form.

Mbevi applied to the court to allow her more time until next week when she will be ready with her facts.

The shocked magistrate enquired from the accused if he had children and he said he had and that his first born was 48 years while the last born was 27 years old.

He further explained to the court that on the material day, the complainant went to where he was and requested him to buy her lunch worth Sh25.

It was then that he gave her the money and then committed the act with her and that it was not his intention but the devil’s.

“I am very remorseful and I will never repeat it and I pray that the court exercises leniency on me” he told the court.

The magistrate therefore remanded him in custody until January 22, 2019 when the facts of the case and the judgment shall be delivered.

Defilement of a child aged 11 years and below carries a sentence of life imprisonment, while those aged between 12 to 15 years draws a sentence of 20 years. Defilers of children aged between 16-18 years are imprisoned for 15 years imprisonment.
