He walked into the Bura Police Station to make a complaint. When he did not find any officer at the report office, he walked out with the occurrence book (OB) and the cell register.
Simon Nyaga Baya then travelled about 50 kilometers to Hola Town where he presented the items to officers at the Hola Police Station for his complaint to be recorded.
This ‘heroic act’ however landed Baya in hot soup, as the officers at the Hola Police Station arrested and charged him with illegally possessing public stores.
Baya appeared before Hola Principal Magistrate Alloys Ndege early this week and denied the charge.
Mr. Ndege released him on a Sh40, 000 bond with one surety of a similar amount after the prosecution did not object to him being granted bail.
Baya was charged that on February 10, 2019 at about 4.00 pm at Hola Town in Tana River Sub County, Tana River County, had in his possession of public stores namely an occurrence book and a cell register of Bura Police Station, such property being reasonably suspected of having been stolen or unlawfully obtained.
The prosecution has lined up four witnesses, all of them police officers, for the case that will be mentioned on February 26, 2019.
It is not yet clear what action would be taken against the officers who were not at the report office when the accused person took the items.
