Impeached Kitui Minister Fights Back in Court

Embattled Kitui County executive for lands Jacob Kakundi has obtained interim conservatory orders restraining County Governor Charity Ngilu from effecting his impeachment pending interpartes hearing.

Speaking to the press Monday after serving the orders to the County Assembly of Kitui, the county assembly Speaker George Ndotto and five members of the ad hoc committee, Kakundi’s legal team led by Musyoki Kimanthi displayed a brave face to save his career following the county Assembly’s resolution on September 16, 2020 to impeach him.

Giving the orders, Kitui High Court Judge Justice Robert Limo set the interpartes hearing for Wednesday September 23, 2020.

Moving the motion at the floor of the house during the impeachment debate, Kyome/Thaana Ward Representative Alex Mwangangi accused Kakundi of orchestrating the unprocedural award of bush clearing tenders to his cronies.

“The bush clearing tenders were meant to benefit the vulnerable members of society. The County executive enlisted the services of women and youth to do the bush clearing on behalf of the contractors. Some of the affected casuals have not been paid to date,” said Mwangangi.

The motion mover said the county executive failed to procure services for the projects within the 2018/2019 financial year for the Community Level Infrastructure Development Programme and thus the county did not benefit from such projects.

Further, Eng. Kakundi was accused of failing to implement the motion on regulation and management of street trade popularly known as hawking and bodabodas, leading to an upsurge of uncontrolled number street vendors in makeshift structures across Kitui and Mwingi Towns.

Mwangangi said that the embattled executive offered unfair services, including discriminative issuance of bulldozer services for three consecutive years, during his reign at the detriment of other needy wards.

On abuse of office charges, the motion mover said that Eng. Kakundi deliberately relied on county administrators such as Ward and Village Administrators to work at the behest of contractors.
