Kimiili MP charged with fraud over sale of vehicle

The  Kimilili MP, Didmus Baraza  was on Tuesday arraigned at a Kajiado Court for obtaining Sh. 450,000 from a businessman fraudulently.

According  to the charge sheet, on diverse dates between March 10 to March 22, 2020, at Kitengela Township within Isinya sub-county with intent to defraud, Baraza obtained from John Irung’u Mwangi Sh.450, 000 by falsely pretending that he was in a position to sell to him a motor vehicle registration number KBX736E, a white Toyota Hiace.

The  MP  who appeared before Resident  Magisrate, Becky Cheloti was charged with the offence of fraudulent disposition of mortgaged goods contrary to section 291 as read with section 36 of the penal code.

Baraza, however pleaded not guilty and was released on a cash bail of Sh.100,000 or a surety of the same amount.

The legislator had on July 20, gone to court to seek an anticipatory bail to bar his arrest over the controversial sale of the public service vehicle.

While seeking the anticipatory bail, Baraza claimed through his lawyer, John Khaminwa that Mwangi had breached a sale agreement which required him to deposit Sh. 200,000 with Uwezo Micro-finance Bank to clear a loan for the vehicle.

The  case will be mentioned on August 27, 2020 with hearing set to commence on 27/11/2020.
