Mother and two sons to serve 3 years imprisonment for assaulting their neighbour

A mother and her two sons have been sentenced to a total of 36 months imprisonment for jointly assaulting their neighbour.

 

Jane Kimoi (mother), Felix Kiptoo and Micah Kiprop were accused of assaulting their immediate neighbour, Susan Jepkeitany Kimechwa causing her actual bodily harm contrary to section 251 of the penal code.

 

They were charged that on November 25, 2018 at around 3pm at Timboiwo village in Baringo Central, Baringo County, the accused persons jointly unlawfully assaulted the complainant.

 

The first accused also faced a second count of assaulting the daughter of the complainant, Jessica Jepchumba.

 

All the accused pleaded not guilty to the charges when they appeared in court Friday.

 

In his ruling, Senior Principal Magistrate (SPM) Paul Biwott stated that the court did not find the first and second accused honest as the second prosecution witness, Jepchumba, testified that she had seen them assaulting her mother Mrs. Jepkeitany.

 

The court found them guilty of the charges in the first count of assault.

 

In their mitigation, the first two accused pleaded with the court to pardon them while the third accused remained silent.

 

In his ruling, Mr. Biwott ordered each of them to pay a fine of Sh 20,000 for the first count or serve one year jail term in default. He ordered the first accused to pay a fine of Sh 10,000 or serve an additional six months for second count.
